All Charges Withdrawn Following Challenge to CCTV Evidence

The Case

Jasper MacCuspie represented a 15-year-old young person who had previously served a period of detention in a Youth Justice facility. Just months after their release, the client was charged with further alleged offending following a police investigation into a home invasion involving a stolen vehicle.

Our client was alleged to have been involved with the stolen vehicle and faced charges of theft of motor vehicle and driving while unlicensed.

The Challenge

Although the charges were not among the most serious offences dealt with in the Children's Court, the client's recent history of detention made the potential consequences particularly significant.

If found guilty, the client faced the risk of returning to Youth Justice custody.

The prosecution relied on CCTV footage that allegedly showed our client entering and driving the stolen vehicle. However, the footage was of poor quality and did not clearly establish the identity of the person shown.

The limited identification evidence provided an important opportunity to challenge the prosecution's case.

The Defence Strategy

Jasper challenged the strength of the prosecution's evidence and entered into negotiations seeking the withdrawal of all charges.

The deficiencies in the CCTV footage and the difficulties in positively identifying our client were put directly to the prosecution.

Despite initially resisting the arguments, the prosecution offered to resolve the matter through a plea to a reduced charge, removing some of the original allegations.

Having considered the evidence and the proposed resolution, Jasper advised the client not to accept the offer and maintained the position that the prosecution should withdraw the charges in their entirety.

This required standing firm in the face of the prosecution's resistance and ensuring the client was not pressured into accepting an outcome where the evidence against them remained questionable.

The Outcome

The prosecution ultimately reconsidered its position and withdrew all charges in their entirety.

This was an excellent outcome for our client, particularly given the risk of further Youth Justice detention if found guilty.

With all charges withdrawn, our client was able to move forward without the prospect of further criminal proceedings arising from these allegations.

The outcome demonstrates the importance of carefully examining the prosecution's evidence, identifying weaknesses and maintaining a firm position where the evidence does not adequately support the allegations.
