All charges withdrawn following successful ID dispute

Case Overview

Our client was charged alongside two other men for a serious knife attack at a Melbourne CBD venue. He faced charges including intentionally causing serious injury and affray. The incident itself was not captured on CCTV, but there was substantial circumstantial evidence, including CCTV from before and after, DNA evidence, witness accounts, and mobile phone data. The stakes were extremely high, as our client had no prior criminal history and was facing a lengthy prison sentence if convicted.

Defence Strategy

We immediately undertook a detailed review of all available evidence. Our team meticulously analysed CCTV footage to identify additional suspects and reviewed body-worn camera footage to find witnesses and suspects who had not been previously identified. We developed a case theory consistent with our client’s innocence. At the committal hearing, our legal team cross-examined key witnesses regarding identification and challenged the strength of the prosecution’s evidence. Through these efforts, we demonstrated significant weaknesses in the Crown’s case.

Conclusion

As a result of our strategic defence, all charges against our client were withdrawn, while his co-accused was sentenced to multiple years of imprisonment. Our client avoided a lengthy prison sentence and maintained his clear record. This case highlights the value of thorough analysis of evidence, strategic cross-examination, and experienced legal representation in achieving exceptional outcomes for clients facing serious criminal charges.
