Securing Immediate Release Following County Court Plea for Drug Cultivation Offences

Case Overview

Lucy Massouras represented a client in the County Court of Victoria who had pleaded guilty to drug cultivation offences.

The client had spent time in custody on remand and was seeking a sentence that would allow him to return home to his family.

The client was charged with cultivation of a narcotic plant pursuant to s 72B of the Drugs, Poisons and Controlled Substances Act 1981.

The primary challenge was persuading the Court not to impose any further period of imprisonment beyond the time the client had already spent in custody. The client faced the prospect of an extended jail sentence, which would have caused further hardship to both him and his family.

The defence needed to present compelling mitigating factors demonstrating why a sentence allowing for the client's immediate release was appropriate.

Defence Strategy

Lucy prepared detailed plea submissions focusing on the client's prior good character, the hardship his imprisonment had caused his family, and the circumstances in which the offending occurred.

She highlighted that the offences were committed during a period of severe economic disadvantage, with the client acting to provide financial support for his family.

Result

The sentencing Judge accepted the submissions advanced on the client's behalf and did not impose any further period of imprisonment beyond the time the client had already served.

As a result, the client was released from custody and was able to return home to his family.

This outcome represented an excellent result for the client.
