Early Rehabilitation and Targeted Defence Leads to Non-Custodial Outcome in Serious Offence

Case Overview

Our client, a 22-year-old man with an excellent education and work history, was charged with sending child abuse material online at the age of 19. This was a highly serious offence, carrying a heavy stigma, and the court generally required to impose a term of imprisonment unless exceptional circumstances could be shown. The client had no prior convictions, was employed, and had already begun psychological treatment.

Defence Strategy

From the outset, our strategy was proactive and multifaceted. Before formal charges were laid, we arranged for our client to commence treatment with a private psychologist, demonstrating early engagement with rehabilitation. After charges were filed, we negotiated with the prosecution, resulting in a plea to a single charge and the withdrawal of several others. At the plea hearing, we successfully argued for a suppression order to protect our client’s health and presented extensive evidence of his positive background, employment prospects, family support, and ongoing treatment.

Conclusion

Our approach convinced the Judge that exceptional circumstances existed, and our client avoided a prison sentence. This outcome highlights the importance of early legal advice, thorough preparation, and tailored strategies for serious criminal matters.
