Avoiding Imprisonment for a Vulnerable Client Facing Multiple Criminal Charges

avoiding imprisonment

Case Summary

Our client was an Aboriginal man experiencing homelessness, with a history of drug addiction and significant social disadvantage. He had faced substantial barriers in accessing stable housing, financial support and other essential services, and his circumstances had brought him into contact with the criminal justice system.

The client faced a range of charges, including drug possession, low-level dishonesty offences and weapons-related offences. Some of the offending occurred in the context of trying to meet basic living expenses without employment or consistent access to Centrelink payments. The weapons-related offending arose in the context of concerns for his personal safety while living rough.

By the time the matter came before the Court, the client had stopped using drugs and was working with outreach services to address his outstanding matters and make progress towards a more stable future.

The Challenge

Although the charges were relatively dated, they remained serious, and the client had relevant prior convictions. This created a real risk of imprisonment.

A custodial sentence would have disrupted the progress the client had made towards recovery and his efforts to secure long-term housing and employment.

The matter also required an understanding of the additional barriers Aboriginal people can experience when engaging with the criminal justice system. It was important that the Court had a clear picture of the client's circumstances, the challenges he had faced and the positive steps he was taking to change his life.

The central challenge was to present the client's circumstances and progress effectively while addressing the seriousness of the offending and the risk of a term of imprisonment.

Our Strategy

Jasper MacCuspie focused on preparing a considered plea that gave the Court a comprehensive understanding of the client's personal circumstances and prospects of rehabilitation.

The defence highlighted the significant disadvantage the client had experienced, including homelessness, drug addiction and difficulties accessing consistent financial support. It was also important to demonstrate that these circumstances did not define the client's future.

Particular emphasis was placed on the progress the client had made since the offending, including becoming drug-free and engaging with outreach services to address his outstanding matters and work towards a more stable life.

The plea sought to demonstrate why a community-based outcome was preferable to imprisonment, which risked undermining the progress already achieved. The objective was to ensure that the Court considered the client's individual circumstances alongside the seriousness of the offences when determining an appropriate sentence.

The Result

The client received a modest fine and was convicted, avoiding imprisonment.

Given the risk of a custodial sentence arising from the nature of the charges and the client's prior convictions, this was a favourable outcome.

Avoiding incarceration allowed the client to continue his recovery and maintain his engagement with outreach services while working towards more stable housing and future employment.

Why Experience Matters in Criminal Defence

Effective criminal defence involves more than addressing the charges themselves. Understanding a client's circumstances, presenting relevant information to the Court and explaining the practical consequences of different sentencing outcomes can be particularly important when a person is experiencing significant disadvantage.

Stary Norton Halphen & Galbally has experience representing clients from a range of backgrounds, including people facing complex personal circumstances alongside criminal charges.

In this matter, careful preparation and a considered plea enabled the defence to present the client's progress and rehabilitation efforts in context. This helped the Court understand why avoiding imprisonment was an important consideration in determining an appropriate outcome.

For anyone facing criminal charges, experienced legal representation can help ensure that their circumstances, rehabilitation efforts and relevant sentencing considerations are properly presented to the Court.
