Case Summary
Our client was a young man with an intellectual disability who faced serious criminal allegations following an altercation at a private gathering.
He was charged with recklessly causing injury in circumstances of alleged family violence involving his girlfriend. The allegations included causing significant facial injuries, including lacerations to the chin and a fractured jaw.
The client had a significant history of prior offending in the Children’s Court, although his history in the adult Magistrates’ Court was more limited. He also came from a background of significant disadvantage and received support through the National Disability Insurance Scheme (NDIS).
The Challenge
The prosecution sought to have the client remanded in custody while the charges proceeded through the court system. Given the seriousness of the allegations and his prior criminal history, securing bail presented a significant challenge.
The application was further complicated by the limited accommodation options available to the client. The only identified address was his father’s home, despite separate offending allegations involving his father and an existing Family Violence Intervention Order between them.
The application required careful consideration of the available evidence, the client’s individual circumstances, the risks associated with detention and whether appropriate support could be provided in the community.
Our Strategy
Jasper MacCuspie prepared a bail application focused on the available evidence, the client’s vulnerabilities and the practical arrangements that could support his release.
The defence highlighted limitations in the evidence available at the time. The account from one witness was only partial, while the complainant’s statement indicated that she could not recall what had occurred. She had also not reported violence to police. These matters were considered in the context of the information available to the Court when deciding whether the client should remain in custody.
The application also addressed the client’s intellectual disability, significant personal challenges and the potential risks associated with detention in an adult custodial environment.
Importantly, the defence drew attention to the supports available to the client in the community and the need to consider whether his circumstances could be managed through appropriate bail conditions rather than continued detention.
The objective was to demonstrate that a structured release into the community was an appropriate option while the criminal proceedings remained unresolved.
The Result
The Court granted the client bail subject to strict conditions.
This was a favourable outcome given the seriousness of the allegations, the client’s prior criminal history and the prosecution’s application for remand.
Although the charges remain outstanding, the grant of bail allowed the client to remain in the community while his matter proceeds through the court system, rather than being held in custody awaiting its resolution.
Being on bail also meant the client could approach the ongoing proceedings without the immediate pressure of continued detention and the associated desire to resolve the matter simply to secure release.
Why Experience Matters in Criminal Defence
Bail applications involving serious allegations can be particularly challenging when a client has a significant prior history, complex personal circumstances or limited accommodation options.
Effective preparation requires careful consideration of the available evidence, the risks relevant to bail and the practical arrangements that may make release into the community possible.
Stary Norton Halphen & Galbally has experience handling complex bail applications involving serious criminal charges. In this matter, Jasper MacCuspie addressed the evidentiary issues, the client’s individual vulnerabilities and the supports available in the community to argue for release under appropriate conditions.
When someone is facing the prospect of being held in custody, experienced criminal defence representation can be important in ensuring that the relevant circumstances are properly presented and considered by the Court.
