Case Overview
Our client was an 18-year-old highly vulnerable young person who was arrested alongside a number of associates following a public altercation on a prominent high street. Police attended the scene shortly after the incident and quickly located and arrested those involved.
The client was charged with affray, unlawful assault, and committing an indictable offence while on bail.
The prosecution case arose from a serious incident in which it was alleged that the group had engaged in conduct that escalated a confrontation with the operators of a local business. The incident was captured on multiple CCTV angles and involved a significant police response, including numerous triple zero calls, attendance by multiple officers, and a large number of civilian witnesses.

These points were supported by precise references to the relevant footage, witness material, and interview excerpts, forming the basis of detailed written submissions to the prosecution.
Result
Following comprehensive review of the material and persuasive submissions on the available evidence, the prosecution ultimately accepted that the client’s conduct was capable of being interpreted as defensive in nature and associated with efforts to prevent further escalation.
On the next court date, all charges were withdrawn.
This result ensured the client was left without a criminal record and was able to move forward without the long-term consequences that would have followed a conviction for serious violent offending.
